i empty it after every use and shake out the filter

You more than likely need to clean your filter. Remove the filter, beat it in your garbage can to knock off the loose dust, run it under some water and squeeze it out a few times, then replace in vacuum.

If it’s a Tyson, take it back. The stuff is expensive garbage.
Could be you have a seal that has moved out of place, check those things,, looks like a black washer ring.
It could be a seal or you may need to replace your heppa filter.
